Terms & Conditions

By registering as a member of our research panel entitled “Kōrero”, you agree to be bound by these terms and conditions, and it is your responsibility to read and understand them.

1. Essential information about Us

1.1 The Kōrero community, found at https://mykorero.com/ is run by Whakaata Māori based at 433 East Tamaki Road, East Tamaki, Auckland 2013, New Zealand.

1.2 Membership of Kōrero is free. You may not use multiple email addresses.

1.3 You must be aged 16 or over and a resident or citizen of New Zealand to be eligible to join the research panel and participate in the Promotion during the Promotional Period.

1.4 Participation in surveys and other market research activities is voluntary. By agreeing to become a Kōrero member, you agree to receive invitations to participate in surveys and other market research activities.

1.5 You may unsubscribe from Kōrero membership at any time. If you no longer wish to receive emails about Kōrero, you may opt-out from using the Kōrero (including, without limitation, from receiving newsletters or communications), at any time, by:

(i) following the unsubscribe procedures described on Kōrero platform; or (ii) (ii) by sending an email to korero@whakaatamaori.co.nz. We will use reasonable efforts to read and respond to each email request within a reasonable period of time after receipt.

1.6 Please see the Kōrero Privacy Policy for information on how we handle information and data following an unsubscribe, termination, or opt-out request.

2. Data Protection and Privacy

2.1 By registering to Kōrero, signing up and participating in our research activities or providing information to us or QuestionPro, you acknowledge you have received notice of Kōrero Privacy Policy and consent to the collection and use of your information by us and contractors in accordance with this policy.

3. Communication

3.1 You can contact us by email at korero@whakaatamaori.co.nz. We will use the email address you have provided to us to contact you.

4. Using Kōrero

4.1 You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use this website content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any of Kōrero content except for your own personal, non-commercial use. Any other use of this website content requires our prior written permission.

4.2 You agree to use Kōrero only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of this website.

4.3 You undertake that all information you give in relation to Kōrero will be as accurate as possible, and understand and accept that providing false or misleading information could lead to being disqualified from Kōrero.

5. Disclaimers and Limitation of Liability

5.1 The content of Kōrero, including the information, names, images, pictures, logos and icons regarding or relating to us, its products and services, is provided “AS IS” and on an “IS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

5.2 We will not be liable for any of the following losses or damage (whether such losses are foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of this website regardless of the form of action.

5.3 We do not warrant that functions contained in Kōrero will be uninterrupted or error free, that defects will be corrected, or that this website or the server that makes it available are free of viruses or bugs.

6. Intellectual Property

6.1 The names, images and logos identifying us are subject to our copyright, design rights and trademarks. Nothing contained in these terms shall be construed as conferring any licence or right to use any of our trademarks, patents, design rights or copyrights.

7. Contributions to Kōrero

7.1 Where you are invited to submit any contribution to Kōrero (including any text, photographs, graphics, video or audio), you agree, by submitting your contribution, to grant us a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to us the rights set out above, please do not submit your contribution to Kōrero.

7.2 Further to paragraph 7.1, by submitting your contribution to Kōrero, you warrant that your contribution: is your own original work and that you have the right to make it available to us for all the purposes specified above; is not defamatory; and does not infringe any law. You indemnify us against all legal fees, damages and other expenses that may be incurred by us as a result of your breach of this warranty, and waive any moral rights in your contribution for the purposes of its submission to and publication on this website and the purposes specified above.

7.3 You agree not to use Kōrero in any way that is illegal or causes damage or harm to us or others. This includes (but is not limited to):

• Sending unsolicited electronic mail to any person for the purpose of advertising or promoting any organisation (spamming);

• Infringing our, or any other party’s, intellectual property rights, including by distributing copyright material;

• Using or distributing the personal information of others in any way without their consent;

• Using the website in any way that is offensive to others, including using inappropriate language or expressions of bigotry or hatred;

• Engaging in harassment, whether through language, frequency, or size of messages

• Attempting to gain unauthorised access to any system, network or account belonging to us or another person (hacking);

• Attempting to intercept, interfere with or deny the website to any another person;

• Introducing or sending anything harmful or destructive (such as DDOs attacks, viruses, worms, Trojan Horses, time bombs or bots) to our or anyone else’s computer system or communications services;

• Engaging in any fraudulent activity, such as the use of a false identity, hiding the source of the message, or making the source appear to be someone else; and

• Using the website in any way that encourages another person to breach the prohibitions covered under these terms of use.

7.4 If you breach these terms and conditions, we may immediately suspend or terminate your membership of the Kōrero community, without any notice or liability to you.

8. Market research activities within Kōrero

8.1 The answers you give us will be treated as confidential unless you have given your consent to the contrary. We will not send you unsolicited mail or pass on your e-mail address to others for this purpose.

8.2 Your cooperation is voluntary at all times. No personal information is sought from or about you, without your prior knowledge and agreement.

8.3 If you no longer wish to receive emails from Whakaata Māori and QuestionPro about the Kōrero community, please “unsubscribe” by emailing korero@whakaatamaori.co.nz.

9. Security Techniques

9.1 We use cookies and other similar devices sparingly and only for quality control, validation and to prevent bothersome repeat surveying. You can configure your browser to notify you when cookies are being placed on your computer. You can also delete cookies by adjusting your browser settings.

9.2 Kōrero has security measures in place to protect the loss, misuse, and alteration of the information under our control.

10. Changes to and termination of Kōrero

10.1 We may make changes to the Kōrero website. In the event we deem a change, at our sole discretion, requires you to be notified, we will notify you by sending an email to the email address you provided.

10.2 If you do not participate in any surveys after 12 months we may terminate your membership of the Kōrero community.

11. Promotional activities

11.1 As a member of Kōrero you may be invited to promotional activities. We reserve the right to open, suspend or terminate such promotional activities at any time without prior notice. For each activity, we will state the conditions of entry, prize(s) available (if any), dates the activity is available and date the prize(s) (if any) will be drawn, as applicable.

11.2. We reserve the right to update the terms and conditions of any promotional activities from time to time by posting an updated version on the Kōrero website. Your continued use of the Kōrero website or participation in surveys and/or promotional activities after we post any such changes indicates your acceptance of those changes.

11.3 We reserve the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity. Failure to provide proof may result in the prize being forfeited.

11.4 We reserve the right, at any time, to verify the validity of any entry and to disqualify any entrant who submits an entry that is not in accordance with these or any other specific terms and conditions or who tampers with the entry and/or selection process. Failure by us to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at our sole discretion.
